INCOTERM 2010

Incoterms (International Commercial Terms)   :
         adalah kumpulan istilah yang dibuat untuk menyamakan pengertian antara penjual dan pembeli dalam perdagangan internasional. Incoterms menjelaskan hak dan kewajiban pembeli dan penjual yang berhubungan dengan pengiriman barang. Hal-hal yang dijelaskan meliputi proses pengiriman barang, penanggung jawab proses ekspor-impor, penanggung biaya yang timbul dan penanggung risiko bila terjadi perubahan kondisi barang yang terjadi akibat proses pengiriman

11  istilah dalam Incoterms 2010:
  1. EXW : Ex Works, pihak penjual menentukan tempat pengambilan barang.
  2. FCA : Free Carrier, pihak penjual hanya bertanggung jawab untuk mengurus izin ekspor dan meyerahkan barang ke pihak pengangkut di tempat yang telah ditentukan.
  3. FAS : Free Alongside Ship, pihak penjual bertanggung jawab sampai barang berada di pelabuhan keberangkatan dan siap disamping kapal untuk dimuat. Hanya berlaku untuk transportasi air.
  4. FOB : Free On Board, pihak penjual bertanggung jawab dari mengurus izin ekspor sampai memuat barang di kapal yang siap berangkat. Hanya berlaku untuk transportasi air.
  5. CFR : Cost and Freight, pihak penjual menanggung biaya sampai kapal yang memuat barang merapat di pelabuhan tujuan, namun tanggung jawab hanya sampai saat kapal berangkat dari pelabuhan keberangkatan. Hanya berlaku untuk transportasi air.
  6. CIF : Cost, Insurance and Freight, sama seperti CFR ditambah pihak penjual wajib membayar asuransi untuk barang yang dikirim. Hanya berlaku untuk transportasi air.
  7. CPT : Carriage Paid To, pihak penjual menanggung biaya sampai barang tiba di tempat tujuan, namun tanggung jawab hanya sampai saat barang diserahkan ke pihak pengangkut.
  8. CIP : Carriage and Insurance Paid to, sama seperti CPT ditambah pihak penjual wajib membayar asuransi untuk barang yang dikirim.
  9. DDP : Delivered Duty Paid, pihak penjual bertanggung jawab mengantar barang sampai di tempat tujuan, termasuk biaya asuransi dan semua biaya lain yang mungkin muncul sebagai biaya impor, cukai dan pajak dari negara pihak pembeli. Izin impor juga menjadi tanggung jawab pihak penjual.
  10. DAT : Delivered at Terminal :
    Penjual membayar untuk pengangkutan ke terminal, kecuali untuk biaya yang berkaitan dengan impor clearance, dan mengasumsikan semua risiko sampai pada titik bahwa barang dibongkar di terminal.
  11. DAP - Delivered di Place
    Penjual membayar untuk pengangkutan ke tempat yang bernama, kecuali untuk biaya yang berkaitan dengan impor clearance, dan mengasumsikan semua risiko sebelum ke titik bahwa barang siap untuk bongkar muat oleh pembeli.

Procedure for Personal Effect Shipment to Indonesia

PROCEDURE PERSONAL EFFECT SHIPMENT IN INDONESIA
Below some requirements on the import of personal effects  brought forward from abroad to Indonesia :
  • For All Customers:
    • Original passport for customer and spouse valid for a minimum of twelve months
    • Original Work Permit for customer
    • Original Residence Permit (KITAS Card) for customer and spouse -- both MUST BE validated for a full twelve month period
    • Customs Application
    • Bank Guarantee
    • Letter of Authorization to Destination Agent
    • Certain vaccinations may be required
    • Inventory (original and one copy - not valued)
  • For Expatriates:
    • Original passport
    • Residence permit (KITAS Card) valid for 12 months (also for spouse)
    • Work Permit valid for 12 months
    • Marital Status Statement (divorced/single only)
    • Single status customer is not normally entitled to a duty-free shipment and may petition to obtain approval from the Embassy or Consulate
  • For Returning Indonesian Citizens:
    • Original Passport
    • Inventory (original, valued and legalized by Embassy/Consulate)
    • Application letter and Import Permit from the Department of Trade
    • Original Statement from Indonesian Embassy/Consulate that customer has been living abroad, stating date of arrival, date of intended return to Indonesia and customer's intent to ship personal effects
    • Letter of Assignment and Reassignment by customer's employer or sponsoring company
    • School certificate or diploma for students
    • License from Indonesian Ministry of Foreign Affair (applied by embassy)
    • Diplomatic card (for vehicle)
  • IF ALL THE ABOVE ARE NOT PROVIDED, HEAVY DUTIES, PENALTIES AND DEMURRAGE WILL APPLY.
CUSTOMS REGULATIONS
  • Consignee or Customer  must be in  Country for clearance
  • Shipments 100% inspected by Indonenesian Custom.
  • A returning Indonesian citizen must have lived abroad for a minimum of three years and must have been in possession and use of the items for at least two years with continued use of the items while in Indonesia to be allowed duty-free entry
  • For expatriates, household goods must have been in customer's possession and use for at least one full year, and be for the Customer's continued private use in Indonesia (not for resale)
  • Only one air and one sea shipment of household goods allowed duty-free
  • Shipments must arrive within three months of date of issuance of KITAS Card
  • It is unwise to include any shipment boxes which are marked with any name but the shippers.  This could jeopardize clearance.
 DUTIABLE/RESTRICTED ITEMS
  • Only one of each major appliance is allowed duty-free with the exception of air conditioners
  • New articles and items not listed on inventory
  • Material in Chinese (pictures, tapes, etc.) will require proper permits and is subject to censorship and confiscation
  • Medicines (prescription required)
  • Cosmetics
  • Antiques (may have problems re-exporting)
  • Large quantities of any type of product will slow clearance and result in high duty
PROHIBITED ITEMS
  • Explosives, weapons, firearms, and ammunition
  • Narcotics and drugs of  various kinds
  • Alcoholic beverages
  • Video tapes laser discs and books are subject to censorship. Prepare a list of titles and authors
  • Animal skins
  • Pornographic and politically sensitive literature
  • Foodstuff
  • Cordless telephones
  • Presence of any DUTIABLE/RESTRICTED/PROHIBITED items in shipment will greatly delay clearance and increase charges considerably.
MOTOR VEHICLES
  • Prohibited except for certain diplomats
PETS
  • Copy of owner's passport
  • Letter of Recommendation from the Department of Veterinary Science
  • Copy of Health Certificate, Vaccination Book and Rabies Vaccination required
  • Local Import Permit must be obtained from the Indonesian Agricultural Department before pet arrives
  • Subject to import duties and taxes
  • Must be for personal/private use and not for resale
  • Pets name, breed, sex, age and color on paperwork
USEFUL INFORMATION 
Indonesia can be a difficult place to clear customs. Normal customs clearance takes from 7 to 10 working days, providing the documentation is order. If duties have been assessed, allow 3 to 4 days after payment to the Indonesian Customs Cashier.
The average time to obtain documentation certifying valid work and residence permits can range from two (2) to four (4) weeks after arrival of the shipper in the Indonesia with a one-year visa from the Indonesian Embassy or Consulate.
It is recommended that the shipper prepare a list of titles and authors of books/publications to allow customs the option of cursory inspection.

LIMITED PROHIBITION GOODS

GOODS WITH PROHIBITIONS, CONTROLS, AND RESTRICTIONS


Goods which are prohibited and restricted from being imported or exported to or from Indonesian territory without the approval of respective authorities :
  1. Hazardous articles and substances such as narcotics and dangerous drugs, flammable, poisons, oxidators, radioactives etc.
  2. Explosive goods/materials; all types and sizes of fireworks
  3. Fire-arms and parts thereof and its ammunitions; airgun; spring-gun or gas-operated-gun;
  4. Imitation of firearms;light or signal/alarm pistols including parts thereof;
  5. Books and certain printed materials (such as books, magazines, leaflets, brochures, newspapers written in Chinese characters and languages; all kind of printed materials in Indonesian language/dialects);
  6. Audio/video records in any medias; transceiver equipment; cordless telephone or telecommunication equipment; color photocopy machine and parts thereof;
  7. Certain plant species are prohibited for import, such as quinine, orchids; endangered species or their by-products; certain kind of fish are prohibited to export, such as Sidat breed (Anguila sp.) , Panacidae shrimp (Panasidae sp) etc.
  8. Unregistered food & beverages; ready made medicines produced abroad;
  9. Products of certain goods which are prohibited for export, such as product rubber lumps, unprocessed hides and raw skin of cow; rattan & rattan core etc.;
  10. Pesticides such as DDT and penrachlorophenol and its salts
  11. Dangerous waste, such as scraps & corrosive iron or steel;
  12. Goods of cultural, archaelogical and or historical value;
  13. Other fauna - flora under CITES
  14. Ozone depleting substance and goods containing ozone depleting substance such as freon for air conditioner or refrigerator with a chemical structure CFC-11, CFC-12 and CFC-13.
  15. Certain amount of Rupiah in cash
All kinds of goods above needs supporting documents that should have prepare by the consignee in Indonesia. And the cargo will be inspected by Indonesian Custom.
